The North West High Court has ruled in favour of the Institute of Market Agencies of South Africa (IMASA), confirming that proceeds from fresh produce sales held by the City of Matlosana Fresh Produce Market are trust funds that must be paid to market agents and producers. The Court dismissed the Municipality’s application for leave to appeal and ordered that a previous interim order remain enforceable with immediate effect. The judgment reinforces the legal protection of producers’ funds and underscores the obligation of municipalities to administer fresh produce market trust accounts in accordance with the law.
